Federal Judge Blocks Trump’s Executive Order To End Birthright Citizenship

On Wednesday, a second federal judge blocked President Donald Trump’s executive order aimed at ending birthright citizenship, ruling that it is likely unconstitutional and contradicts the nation’s 250-year history of granting citizenship by birth.

US District Judge Deborah Boardman issued a nationwide preliminary injunction against the order, which had faced immediate legal challenges and was temporarily halted by another judge shortly after it was issued.

Boardman explained that the order “conflicts with the plain language of the 14th Amendment, contradicts 125-year-old Supreme Court precedent, and runs counter to our nation’s 250-year history of citizenship by birth.”

She added that no court in the U.S. has ever supported the president’s interpretation, and her court would not be the first to do so.

The case was brought in Maryland by five pregnant women whose babies could be affected by the order, as well as two immigrant-rights groups.

Boardman, appointed by President Joe Biden, stated that the injunction must be applied nationwide to ensure the groups’ members receive full relief.

She also noted that the government would not be harmed by blocking an executive order that is likely to be deemed unconstitutional.
