Court Gives Order On Tinubu, Ibas, Fubara Concerning Emergency Rule

A Federal High Court in Abuja has directed that court documents challenging the declaration of a state of emergency in Rivers State be served on President Bola Tinubu, Sole Administrator Ibok-Ete Ibas, and the suspended Governor Siminalayi Fubara.

Justice James Omotosho issued this order on Monday and also instructed that the court papers be served on the Attorney General of the Federation, Lateef Fagbemi (SAN), before adjourning the case until May 21.

Earlier, the applicants’ lawyer, Ebun-Oluwa Adegboruwa (SAN), informed the court that they required an adjournment to facilitate the service of these documents.

Yirbari Israel Nulog, Nengim Ikpoemugh Royal, and Gracious Eyoh-Sifumbukho are asking the court to nullify the appointment of Ibas as the sole administrator of Rivers State and to prevent him from acting in that role following his appointment on March 18.

Their requests include “an order of injunction restraining the 1st (Tinubu) and 3rd (Ibas) defendants, along with their agents and representatives, from treating or continuing to treat the deputy governor and members of the House of Assembly as suspended by the 1st defendant (Tinubu).”

They argue that, based on Sections 1(1) and (2), and 176(1) and (2) of the 1999 Constitution, they, as indigenes and residents of Rivers State, are entitled to a democratically elected Governor who serves as the state’s chief executive.
