Rivers Assembly Raises Alarm Amid Impeachment Process Against Fubara, Deputy

The Rivers State House of Assembly has expressed alarm over alleged secret plots by unnamed persons to use High Courts located outside the Port Harcourt Judicial Division to stall the impeachment of the Governor and Deputy Governor.

In a statement released on January 11, 2026, signed by the Chairman of the House Committee on Information, Petitions and Complaints, Enemi George, the Assembly claimed it had reliable information that individuals are attempting to secure ex parte orders.

These orders would be intended to illegally stop the House from performing its constitutional duties.

The legislators cautioned that any such move would be a direct subversion of the Nigerian Constitution.

To support their position, they pointed to Sections 272 (3) and 188(10) of the 1999 Constitution (as amended), arguing that these sections restrict court jurisdiction regarding the tenure of elected officials and explicitly prevent courts from interfering in impeachment proceedings.

They further cited recent Court of Appeal rulings that had previously overturned similar ex parte orders.

The statement noted that all officials involved in the impeachment have been served with formal notices of gross misconduct.

The Assembly urged them to respond through the proper channels rather than engaging in what it called “subterranean moves” to bypass the law.

With the backing of Speaker Martin Chike Amaewhule, the House called for restraint and a commitment to the rule of law.

Hon. Dr. Enemi Alabo George concluded the statement by reaffirming that the Assembly remains focused on its constitutional mandate and will not be swayed by attempts to “malign the Assembly or intimidate its members.”
