The Federal High Court in Abuja on Tuesday officially “dismissed a suit filed by Sen. Samuel Anyanwu, the former factional National Secretary of the Peoples Democratic Party (PDP), seeking recognition as the party’s scribe.”
Judge Mohammed Umar reached the decision following the “expiration of Anyanwu’s tenure as secretary of the party in December 2025.”
The legal action, marked FHC/ABJ/CS/254/2025, had originally targeted the Independent National Electoral Commission (INEC) and Umar Damagun, the “former acting National Chairman of PDP,” as the primary defendants.

Anyanwu had requested an “order of interim injunction, restraining INEC from accepting, acting on, or giving effect to any correspondence from the PDP not signed by him.”
He further sought to stop Damagun from sending any party documents to INEC that were “not countersigned by him.”
As the case progressed, the court joined several other parties, including Sunday Udeh-Okoye, Dr Ali Odela, and Mr Setonji Koshoedo.
During the proceedings, Anyanwu’s counsel, U.C. Njemanze‑Aku, admitted that since his client’s tenure ended last December, “it was improper to continue with a matter that had been overtaken by events.”
He told the court, “In the interest of justice, I apply to withdraw this matter to save the time of the court.”
While INEC’s lawyer, Akintayo Balogun, argued the suit “ought not to have been instituted in the first place” and demanded a “N1 million naira cost,” the plaintiff’s team resisted.
Njemanze-Aku argued that “it is not fair to penalise the plaintiff,” maintaining that “We owe a duty to the court, and to avoid wasting its time, we decided to withdraw the case.”
Ultimately, Judge Umar dismissed the case but declined to grant the high financial penalties requested by the defendants.
“Since you have joined issues, I am going to dismiss this matter. The matter is hereby dismissed,” he ruled.
Regarding the request for damages, the judge noted that “The delay is not on any of the parties. The situation made it so. For this reason, I award no cost.”
This dismissal concludes a long-standing “internal conflict in the party” that began when Anyanwu left his post to run for the “2023 Imo governorship election, which he lost.”
Despite various appeals and a “Supreme Court” ruling in March 2025 that originally “sacked Anyanwu as the national secretary,” the legal battle had persisted until his official term ended.
