A Federal High Court in Port Harcourt has thrown out a lawsuit brought by the Labour Party in Rivers State contesting the alleged defection of the suspended Speaker of the Rivers State House of Assembly, Martin Amaewhule, and 26 other members.
Presiding Justice Emmanuel Obile dismissed the case on Tuesday, referencing a recent Supreme Court judgment that he stated had already resolved the matter of defection within the suit.

Justice Obile ruled that the court lacked the authority to rule on an issue that the Supreme Court had already definitively decided.
Ken Njemanze (SAN), the defendants’ lawyer, had argued in his final written submission that the court should dismiss the suit in light of the Supreme Court’s decision, which affirmed the lawmakers’ legitimacy.
However, the Labour Party’s lawyer, Clifford Chuku, contended that the issue of defection was a related but separate matter in the Supreme Court case and urged the court not to dismiss their suit.
