An Ikeja High Court on Tuesday dismissed the defamation lawsuit brought against Instagram personality Martins Otse, also known as Verydarkblackman (VDM).
Human rights lawyer Femi Falana (SAN) and his son, Folarin (Falz), had initiated the lawsuit against VDM.
Falana filed the suit following an audio recording by cross-dresser Bobrisky, who accused Falana and his son of obstructing justice.
The claimants were seeking N500 million each in damages for a video VDM posted on his social media platforms.

When the case was called on Tuesday, neither Falana, his son, nor VDM were present in court.
However, the respondent’s lawyer, Mr. Niyi Alagbe, representing Mr. Marvin Omorogbe, informed the court that he had previously filed an application for a stay of proceedings before Justice Fimisola Azeez.
The Falanas’ lawyer, Mr. Omotayo Olatunbosun, responded that he received the application on Monday around 4:15 p.m.
Olatunbosun argued that the scheduled matter for the day was the preliminary objection, which was ready for hearing, and that the new application was intended to delay the proceedings.
Olatunbosun urged the judge to proceed with the day’s business.
Justice Matthias Dawodu noted that the application in question was not in the court file and questioned why he was being asked to handle the case when the main lawsuit was already before another court.
Dawodu dismissed the suit, stating that insisting on proceeding would be pointless since the substantive suit was before a different judge.
“Consequently, this suit is hereby struck out,” he ruled.
