Why Court Rejected Nnamdi Kanu’s Request To Be Transferred From Sokoto Prison

Justice James Omotosho of the Federal High Court in Abuja has refused an urgent application filed by Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), who sought to be moved from the Sokoto Correctional Centre to a custodial facility in or near the Federal Capital Territory (FCT).

Following his life imprisonment sentence on November 20 for seven terrorism-related charges, Kanu was moved to Sokoto due to safety concerns at the Kuje facility.

However, Kanu—through the Legal Aid Council and his consultant Aloy Ejimakor—filed an ex-parte application marked FHC/ABJ/CR/383/2015, asking the court to order the Federal Government or the Nigerian Correctional Service (NCoS) to transfer him to the Kuje Custodial Centre in Abuja or the Keffi Custodial Centre in Nasarawa State.

In a motion personally signed by him, Kanu argued that being detained over 700 kilometres away in Sokoto made it “impracticable to prepare his notice of appeal and record of appeal.”

He emphasized that his legal consultants, relatives, and associates—all critical to his defense—are based in Abuja.

On Monday, Justice Omotosho declined the request, ruling that an order for transfer could not be granted “without hearing from the Federal Government.”

The judge maintained that the respondents, the Federal Government and the NCoS, ought to be put on notice for them to respond appropriately in the interest of justice before a decision could be made.

Justice Omotosho directed that the application be converted to a motion on notice and subsequently fixed January 27, 2026, for the formal hearing of the motion.
