Court Bars Rivers Chief Judge From Acting On Assembly’s Impeachment Directive

A Rivers State High Court in Port Harcourt has issued an order preventing the State Chief Judge, Justice Simeon Chibuzor Amadi, from accepting or acting upon any communication from the House of Assembly regarding the impeachment of Governor Siminalayi Fubara and Deputy Governor Prof. Ngozi Nma Odu.

The ruling was delivered by the Oyibo Local Government Area High Court, sitting in Port Harcourt, following two separate legal actions initiated by the Governor and his deputy, identified as Suit No. OYHC/7/CS/2026 and Suit No. OYHC/6/CS/2026.

Through these interim injunctions, the presiding judge, Justice F. A. Fiberesima, restrained Speaker Martin Amaewhule, the Clerk of the House, the Chief Judge, and 31 others from advancing the impeachment proceedings.

Specifically, Justice Amadi is prohibited for a period of seven days from “receiving, forwarding, considering or acting on any request, resolution, articles of impeachment or any form of communication” aimed at forming an investigative panel to probe the alleged misconduct of the state’s top executives.

In granting the motions ex parte, Justice Fiberesima authorized the claimants to serve the court orders and originating processes on the 1st to 31st defendants by “pasting them at the gate of the Rivers State House of Assembly Quarters.”

Additionally, the court ordered that the Chief Judge be served through any judiciary staff member at his chambers.

The court has adjourned the case until January 23, 2026, for the hearing of the motion on notice.
