Court Delivers Ruling On Nnamdi Kanu’s Motion Seeking Transfer From Sokoto Prison

Justice James Omotosho of the Federal High Court in Abuja has struck out an ex-parte motion filed by the convicted leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, who was seeking a transfer from the Sokoto Correctional Facility.

During Tuesday’s proceedings, Kanu’s representative from the Legal Aid Council, Demdoo Asan, requested to withdraw from the case, citing irreconcilable issues with the applicant.

Asan revealed that while he had been in “constant phone communication with the relatives of the applicant,” they failed to show up to depose to the application despite multiple “phone calls and promises to appear.”

The legal officer further disclosed that Kanu attempted to micro-manage the legal strategy, stating, “He wants to write down what I would say while in court. But, as an officer of the court, I can’t in good faith accept that.”

He emphasized the independence of the legal profession, adding, “As officers of the court, when a matter comes to us, we handle it as we see fit; otherwise, the applicant can find legal help elsewhere.”

In his ruling, Justice Omotosho commended the lawyer for “upholding the dignity of the court” and officially granted the Legal Aid Council leave to withdraw.

The judge noted that the motion was “incompetent” and observed that there was no “proof of service before the court” regarding the other parties involved.

Consequently, the judge ordered that the motion be “struck out for lacking competence.”
