Nnamdi Kanu Asks Justice Nyako To Recuse Herself From His Case

Nnamdi Kanu has requested that Justice Binta Nyako of the Federal High Court in Abuja recuse herself from his case, expressing a loss of confidence in the court.

During the resumed hearing, Kanu, the leader of the Indigenous People of Biafra (IPOB), stated that Justice Nyako had not complied with orders from the Supreme Court.

Speaking in open court, Kanu urged her to step down from his trial.

In response, Justice Nyako stated she would be willing to recuse herself and had no objections to his request.

She indicated that she would send the case file back to the Chief Judge for reassignment and any necessary actions.

Kanu then instructed his lawyer, Alloy Ejimakor, to sit down as he stood from the dock to address Justice Nyako.

He referenced the Supreme Court’s ruling, which raised questions about the jurisdiction regarding the alleged broadcast that forms the basis of the federal charges against him.

Kanu also cited portions of the Supreme Court’s judgment that highlighted concerns of bias against Justice Nyako.

The Federal Government’s counsel, Adegboyega Awomolo, had previously informed the court that he was prepared for the trial to commence; however, it could not proceed under the current circumstances.

Kanu was re-arrested in Kenya in 2021 by the Federal Government and brought back to Nigeria to face terrorism charges.

Despite pleading not guilty, Justice Nyako denied him bail, citing his previous failure to comply with bail conditions, for which Senator Abaribe had acted as his surety.

Kanu has remained in the custody of the Department of State Services as ordered by the Federal High Court in Abuja.
