The Court of Appeal has overturned a Federal High Court judgment in Kano that had voided the composition of the Kano State Independent Electoral Commission (KASIEC) and the local government election KASIEC conducted on October 26, 2024.
In three unanimous judgments delivered on Friday, a three-member panel led by Justice Biobele Abraham Georgewill ruled that the Federal High Court lacked jurisdiction to hear cases concerning the composition of state electoral bodies and the qualifications of their members.
The Court of Appeal allowed the appeals filed by the Kano State Attorney General, the Kano State House of Assembly, and KASIEC, striking out the original suits for lack of jurisdiction.

It further stated that the appropriate court with the necessary jurisdiction is the High Court of Kano State.
In a fourth judgment on Friday, the Court of Appeal also reversed another ruling by the same Federal High Court in Kano.
This earlier ruling had rejected the list of candidates submitted to KASIEC by the Musa Kwankwaso faction of the New Nigeria People’s Party (NNPP) for the last local government election in Kano State.
The appellate court held that the subject of this case, which involved a leadership dispute within the NNPP and the authenticity of candidate lists from two factions, was outside the Federal High Court’s jurisdiction.
It added that issues of party leadership and candidate nomination are not justiciable.
