The Nigerian Bar Association (NBA) has threatened to initiate contempt of court proceedings against the Inspector General of Police (IGP), Kayode Egbetokun, and the Force Public Relations Officer, CSP Benjamin Hundeyin.
This follows the police’s recent announcement that they would resume enforcing the controversial tinted glass permit policy on January 2, 2026.
In a statement released on Tuesday, NBA President Afam Osigwe described the planned enforcement as a “grave affront to the majesty of the court” and a subversion of the rule of law.

The association argued that because the matter is currently before the Federal High Court in Abuja (Suit No: FHC/ABJ/CS/1821/2025), any executive action taken to bypass the judicial process is illegal.
The NBA’s challenge against the policy is built on several key arguments:

Legality: They claim the Motor Tinted Glass (Prohibition) Act of 1991 is a military-era law that fails to meet democratic standards.

Extortion Concerns: The association alleged that the policy is a “brazen revenue-generating drive” rather than a security measure, noting that fees are reportedly paid into a private company’s account.

Human Rights: The NBA noted that previous enforcement led to widespread reports of harassment and civil rights violations, particularly against the youth.

Citing the landmark Supreme Court case of Governor of Lagos State v. Ojukwu, the NBA warned that if the IGP refuses to halt the policy, they will pursue committal proceedings until the police leadership “purges themselves of contempt.”
They also called on President Bola Tinubu to intervene, warning that the policy would impose “unjustified financial hardship” on citizens.
In response, the Nigeria Police Force (NPF) maintained that the resumption is necessary to combat rising security threats like kidnapping and armed robbery.
CSP Hundeyin clarified that the previous suspension of the policy was a voluntary gesture of goodwill, not a court-mandated order, and insisted there is currently no legal restraint preventing the police from enforcing the law.
