The Chief Judge of the Federal High Court of Nigeria, Justice John Tsoho, has denied the request from Nnamdi Kanu, the detained leader of the proscribed Indigenous People of Biafra (IPOB), for Justice Binta Nyako to recuse herself from his case.
Justice Tsoho returned the case file to Justice Nyako, explaining that two other judges had previously recused themselves from the matter.
He noted that Kanu’s case was reassigned to Justice Nyako due to its lengthy duration, dating back to 2015.
Given her extensive involvement in the case, she was considered the most appropriate judge to oversee its resolution.

However, Justice Tsoho indicated that if Kanu still wishes to pursue the recusal of Justice Nyako at the next hearing, he must file a written motion on notice along with an affidavit outlining the grounds for the request.
Kanu is also required to serve this motion to the prosecution team and appear before Justice Nyako for her assessment and decision on the matter.
Kanu’s Special Lawyer, Aloy Ejimakor, confirmed the update to Channels Television and mentioned that Kanu’s team is awaiting an official notice from the court along with a new hearing date.
Justice Nyako had previously recused herself from the case after Kanu and his lawyer, Aloy Ejimakor, expressed concerns about her handling of the case, accusing her of ignoring Supreme Court orders.
